Sivar Rajab Khan is the principal and founder of Sivar Legal and Notary Service. Sivar has years of experience, having worked in diverse legal settings. Sivar’s practice areas include, but are not limited to, notary services, provincial offences, small claims court, landlord and tenant, workplace and safety, and proceedings before the Ontario Social Benefits Tribunal. Sivar’s professional background is both extensive and diverse, having completed her Bachelor’s Degree at the University of British Columbia and obtaining her Paralegal Diploma from CDI College. Throughout her career, she has gained valuable experience across multiple industries, including leading communications companies and community organizations. Additionally, Sivar is actively engaged in movements that advocate for positive social change, further demonstrating her commitment to both legal excellence and community involvement.

As a Notary Service and Commissioner of Oaths certified in the province of Ontario, we would like the general public to be aware that the Notaries Act does not permit notaries to exercise their powers without being in the person’s physical presence, unless regulations so provide. To date, no such regulations have been made by the Ontario government.

Licensees offering online notary services may be subject to regulatory action by the Law Society. Furthermore, the documents notarized in this manner may be invalid and not useable for their intended purpose.

As such, you the client cannot use the documents which have been notarized for you via virtual signings.

However, the use of remote or virtual signing and witnessing may be used to complete or witness certain documents, such as administering and taking of oaths under the Commissioners for Taking Affidavits Act and witnessing wills under the Succession Law Reform Act, if the required conditions are met.
