Facts first.

Atty. Mans Carpio has filed a criminal complaint before the Quezon City Prosecutor’s Office against Bangko Sentral ng Pilipinas Governor Eli Remolona Jr., AMLC Executive Director Ronel Buenaventura, and several members of the House led by Gerville Luistro. The allegations point to violations of the Anti-Money Laundering Act, the Bank Secrecy Law, and the Data Privacy Act of 2012—arising from what he claims to be the unlawful disclosure of bank-related information.

Now the framing matters.

Because Mans Carpio is not the subject of the investigation.

It is Vice President Sara Duterte.

And yet, the complaint he brings is not about innocence or guilt—it is about process. About limits. About whether institutions tasked to guard financial intelligence crossed the line from lawful inquiry into unauthorized exposure.

Let’s be precise.

Yes, the Anti-Money Laundering Act allows disclosures—but only within tightly defined channels. Hindi ito blanket authority to release information simply because there is political interest or a legislative hearing. The law requires procedure, purpose, and proper authorization. Strip any one of those, and the disclosure becomes questionable.

The same tension exists under the Bank Secrecy Law. While exceptions do exist, they are not self-executing. They require a clear legal anchor—a court order, a properly initiated case, or a statutorily recognized exception applied correctly. Hindi puwedeng i-shortcut ang proseso dahil lang mataas ang profile ng iniimbestigahan.

And this is where the discomfort lies.

Because when financial intelligence—arguably among the most protected classes of information—is brought into the open without a clearly demonstrated legal pathway, it creates a chilling effect. Today, it is a Vice President. Tomorrow, it could be anyone.

The Data Privacy Act reinforces that line. It does not prohibit all disclosures—but it demands that any processing or sharing of personal data must be lawful, proportional, and necessary. If the disclosure was excessive, premature, or not strictly within mandate, then the protection of the law is triggered.

So this is not a simple defensive move.

This is a procedural challenge—a reminder that even the pursuit of accountability must remain within the architecture of the law.

Because here’s the uncomfortable truth:

You can investigate Sara Duterte.
You can scrutinize every peso, every transaction, every trail.

But you cannot do it by breaking the very laws meant to govern that investigation.

Otherwise, the evidence you build becomes vulnerable.
And the case you think you are strengthening—begins to weaken from within.

'GO BACK TO LAW SCHOOL' - REMULLA

Ombudsman Jesus Crispin Remulla said there is “no such thing as inhibition” in corruption cases, opposing the request of the camp of former Speaker Ferdinand Martin Romualdez for the Office to inhibit from a possible preliminary investigation. Remulla stressed that the Ombudsman is bound by its constitutional duty to act on complaints.

Romualdez, in a letter sent by his lawyer, argued that Remulla and Assistant Ombudsman Mico Clavano had already tagged him a “master plunderer” in connection with alleged anomalous flood control projects, even though no criminal case has been filed against him. His camp sought the Office of the Ombudsman’s inhibition, citing alleged violations of due process and claiming he had been “prejudged.”
