Okay so I see there questions that need to be answered.

1. I'm not dead, I'm not ignoring you, or I'm not running away.

2. the only update I can give you is we are still working on the 1st list. I did say would take a month or two, but. We will get those people resolved by for the end of February then I will post the next one at the start of march.

Hello everyone,
Since court went good for the most part.
All charges against John are being dropped. Unfortunately he has to go to Anger management classes for 27 weeks.
What that means for you guys we will be opening up later in 2019.
I am posting the first five people (first name only) I will be resolving for the following 1-2 months, then I will do the next 5 after the these guys have been resolved.
I plan to do more (10 or more at time) as we progress into the year.
However, there is only so much we can do at a time so just keep that in mind.

This will begin in January.
I will say it again after these 5 have been resolved I will post the next 5 I will resolve with either refunding them or providing them for what they purchased.

*** This update is directed towards any FSD customers who have outstanding NFA (National Fi****ms Act) items pending final disposition ***

While all are welcomed to read, I will warn that one will find it's a very lengthy post pertaining solely to NFA class weaponry.

My name is Michael Dresner and I own Law Enforcement Sales. I am a 07/02 FFL/SOT manufacturer and share the same premise address (commercial partitioned building) as FSD at 5110 Harriman Hwy in Oliver Springs.

I have been asked to assist with the dispositioning of all FSD’s remaining NFA inventory to you, their customers. This request has come through several collaborative sessions with FSD, ATF and myself. All parties agree this will afford the quickest and smoothest resolution for all involved.

Last week, along with KJ, I began assessing all NFA inventory that was found here onsite. First, we inventoried all NFA items that are physically here on the premise. Then, by utilizing the NFRTR (ATF’s NFA Registry Database), I compiled a second inventory of items the online registry had recorded as being here on premise. Both the physical and electronic inventories were cross referenced with all items falling into one of the 3 categories below.

1) APPROVED w/Form 4
- Item is HERE on premise
- Customer’s Form 4 is HERE on premise
- PENDING ACTION-> FSD Schedule time for customer to come in and pick up
- COMMENTS-> Best outcome given the circumstances, scheduling the pickup was all that was pending. Most ALL of these were finalized and transferred to the customers this week. There are just (2) left now that are waiting for pickup. KJ is facilitating these.

2) APPROVED w/out Form 4
- Item is HERE on premise
- Customer’s Form 4 is NOT here on premise
- Item is NOT on NFRTR (denoting FSD is no longer listed as primary owner)
- PENDING ACTION-> FSD needs to call ATF and get a replacement Form 4
mailed/faxed, then schedule time for customer to pick up
- COMMENTS-> These all WOULD have had an APPROVED Form 4 mailed at some point prior that was either lost or never received. While aggravating, this is still not a bad outcome in regards to timing left to finalize. There are only (3) in this category though. KJ will be facilitating these as well.

3) ALL Others – CANCELS / NOT FILED / VOIDED / NON-COMMITTED INVENTORY
- Item is HERE on premise
- Item is STILL on NFRTR (FSD still showing ownership)
- Customer’s Form 4 NOT was not completed, canceled, voided, unknown, etc.
- PENDING ACTION-> Complete a NEW Form 4 on and then re-file with BATFE.

LAW ENFORCEMENT SALES will ONLY be assisting with any NON-APPROVED status (category 3) items. FSD will retain closure responsibilities for all APPROVED status (categories 1 & 2) items.

As far as the Number 3s go…

The GOOD

- Most items here have post-it notes or inventory tags with customer’s names on them that will help provide me a quick validation and confirmation of which items is slated as yours.

- There’s also a good bit that do NOT have names on them. Notes fell off, weren’t put on, whatever but as folks prove ownership, if a matched item is not easily found, chances are there’s still may be an unknown one that can.

The BAD (sorry)

- There’s still quite a few of these in this bucket which means a lot of you are going to fall into this category and will have to re-file for them to be processed.

- I have been told that nothing transpired filing wise at the Oliver Springs facility post move. That being said, it is my best assessment that ALL of these were either items that never were filed initially (for whatever reasons) or WERE filed but had clerical errors which were not received or resolved in a timely matter. The ATF only gives a 30 day window to return and they will then cancel the filing and initiated the refund process on the tax.

WHAT DOES RE-FILING MEAN TO YOU?

1) You’ll need to get reprinted (fingerprints) ** SEE RP NOTE

2) You’ll need to get (2) new passport photos ** SEE RP NOTE

3) You’ll need to come by my shop to complete and pick up the new forms. (This all can be handled via USPS as well if you desire, I have customers all over the state I do this for. I have a PayPal account you can use to pay for postage, etc.)

4) If filing under a trust, you’ll need to get a copy of the trust made so it can be sent in with the forms. I have some here that Rachel did for a few of you. I will let you know if I have a copy but probably safest if you bring a copy with you.

5) The $200 ATF transfer tax WILL have to paid again as these will be new filings. Whether you 1) pay this and file immediately, then seek reimbursement from FSD afterwards or 2) wait for the original to be refunded by FSD and re-file once it's received is a decision each one of you will have to make.
When forms are canceled (as in the case of these original filings), the ATF first attempts to credit the source that paid the tax initially. For any of you who purchased Buy It Local through SilencerShop, if you paid the tax at time of ordering, you should get/have gotten back the $200 refund to that same card. If you paid FSD directly, you’ll need to seek reimbursement means back through FSD. Unfortunately there's no way I am aware to track what state a refund is in, I have had them in the past take nearly as long as the approval process does.

** RP NOTE ** RP – Responsible Person.. In regards to both the fingerprints and photos, if you’re filing as yourself solely (not a trust) this is just YOU that needs this done. If filing under a trust, EVERY responsible person on the trust document needs to have this done.

** TRUSTS ** - I know some of you may have went the trust route back before 41F to circumvent the need for prints and photos. Trusts are still a valuable transfer means if you need to share the item or maybe you have several items under the trust now and want to be consistent. IF you do decide to re-file know that individual/direct filings are averaging just 4-6 months where the trusts transfers right at a year in processing time. Just something to think about if speed matters more to you than flexibility as the direct filings are twice as fast or half as slow is probably a better analogy.

WHAT will LAW ENFORCEMENT SALES do?

1) After obtaining your information, I will complete your forms 4 and get them ready for submittal

2) I can provide fingerprint cards if any need them

3) Happy to answer any questions you have pertaining to the filing

4) I will extend to each of you the same curtesy I do my customers and allow you, at any time, to come and inspect your item, test fire it out back if you desire, immediately take any included/purchased mounts, documents, tools that came with it if you wish to.

I’ve been in the NFA world for almost 30 years and handle my Form 4 filings a little different than most. I complete the forms and then sign my parts. I can provide you with instructions on completing your areas (if you come to pick them up this is usually done in my presence). I then hand them over to you so that YOU mail them to the BATFE yourself.
This keeps people from wondering if I filed them, when did I filed them, did I sit on them, etc.. It puts YOU in charge of sending YOUR forms off as quickly as you desire to.

I provide a large mailable addressed (BATFE) envelope where all you have to do is sign the forms, drop your $200 ATF check and a copy of your trust (if applicable)… put a few stamps on the front and mail.

I recommend the tax be paid with a person check. Even for trusts, the ATF doesn’t care WHO pays it as long as it gets paid. A personal check gives you the quickest notification when it posts (will be 2-3 weeks from receipt) that they did receive it and you’re in the pipeline cooking. No need to do money orders or certified mail.

******* COUPLE BITS ABOUT ME ASSISTING ********

1) First and foremost, I have the deepest empathy for you all. This is a primary reason I have agreed to assist. Many of you that have stopped by over this past year and met me, I hope you have always found I’m available, my door was always opened and I’ve been willing to assist with whatever I could.

2) Please understand that Law Enforcement Sales did not receive or benefit one single penny from any monies that were ever paid to FSD for these items. I will do my absolute best to help everyone as much I possibly can but I also have a business to run here myself and I stay extremely busy. I am kindly asking now if you all would please stay conscious of that. This is going to eat up a ton of time to accomplish. Each form has to be entered, printed, checked, signed, envelope made, etc.. it takes 15-20 min each on a good day and qty wise I have more here right now than I've transferred cumulative over the last 2 years.

3) I am not asking any of you for any compensation for my time. If you’ll work with me you’ll find I’ll afford the same back to you. It is my intention to get through this as fast as we possibly can. I completely understand all your frustrations, they’re painfully understandable and justified. I hope to get the trains back on the track and you onto the road of recovery as painlessly as possible.

4) I unfortunately do not have the time available it would take for someone to call the ATF, try to track down what happened to your original form, help with any recovery or reimbursement efforts, attempt to obtain any prior print card/photos you’ve already generated, etc., etc. I sincerely hope you understand.

Ok .. What do I (LAW ENFORCEMENT SALES) need from YOU?

1) If you would please contact me (info below) and give me …

a. Your Name and Contact Information

b. If trust, the name of the trust (in case that’s how it’s marked with the name tags)

c. Make and Model of the suppressor purchased

d. Approx. date purchased

e. Approx. date you think the original F4 was filed

f. ANY related information you feel may be helpful to me.. Did Rachel tell you anything, any emails, did you call the ATF, did you get an error correction form, were told your form was canceled, etc. I'm starting below zero honestly so help me help you. Anything at all that might be helpful to keep things expedited.

I can only imagine the number of lists you’ve already sent, emails, calls, etc. but having access only to the items and sticky notes, getting this back quickly will allow me to get you back to moving quickly.

I will take this information and check against the inventory and send a response back letting you know if I was able to find an item with your information attached or a potential “unknown/unspoken” that matches, etc.

Hello everyone, this is KJ, John and Rachel's son, Wanted to let you know that Rachel is no longer in charge of operations here at the shop.

We are working diligently to correct the mess that she caused and left me and John to fix.

If you have a serialized item that is in our possession please message me here, I am currently returning them as quickly as possible.

If you have any recepts or consighnment agreements or any paperwork proving ownership please send them as well.

Finaly, I want to offer my deepest and most sincere aploglogies to everyone affected by Rachels mismanagemnt and actions, we will correct all deficiences as quickly as we possibly can. Everyones issues will be adressed in as timely of manner as posibble. We will have a better idea and plan for rectification after we resolve the ongoing court proceddings.

Rachel here for FSD: It's been a while since the last update and admittedly is hard to read through all of the comments in the previous "Update" thread so I'm starting a new one here.

Yes, July came and went and we were able to get a LOT of fi****ms, suppressors, refunds, and orders into the hands of our customers. However, we didn't reach our goal of having everyone taken care of by the end of July but that hasn't lessened my resolve to return all fi****ms, suppressors, refunds, SBRs, or anything else. If anything, there's more urgency than ever since obviously I set a deadline I couldn't reach.

Again, I'll reiterate that rather than file bankruptcy, we're staying the course in order to get everything back to our customers. The aforementioned "option" was utilized (and even used as a bargaining tool) by one of our competitors in the past and we just don't feel that it's right to take the "easy" way out and leave you all holding the bag.

I have received every email, inquiry, and FB message regarding the property that needs to be returned. I may not have been able to respond to them all yet, but I assure you, I know that they're there and appreciate how difficult this process has been for everyone. You didn't deserve to have to wait this long on items you ordered or requested and I'm sorry for all of the inconvenience and animosity this has caused.

I have received a handful of suppressor stamps in the mail from the ATF recently and am still anxiously awaiting their reply regarding the list of serial numbers I sent them a while back.

I will continue to make appointments and get all items back into the hands of those they belong to as quickly as possible. THANK YOU to those who have been patient and understanding with the process and who are giving us time to collect the resources we need in order to complete the transactions needed in order to return your items (and/or refunds) to you.

I will make it a point to do a better job in updating you here. I shouldn't have let it go as long as I did without an update. I look forward to contacting you all soon.

Update 7//18: First and foremost, please allow me to apologize. After a lengthy heart-to-heart with a very understanding customer on Friday, I've realized that I have been aggressive, combatant, and defensive in my posts to you. You just wanted information about your gun, NFA item, or refund and I have been a pain in the butt to deal with. For that, I am sorry.

This move, the delays, the governmental red tape...has been so extremely difficult. Yes, there were some things that were out of my control...however, there were some things that I completely dropped the ball on that were within my control.

1. My communication to y'all could have been vastly better. I know that. I was overwhelmed and let it affect my correspondence to all of you. I try each day to do better. I still fall down on it a lot more than I should, but I'm constantly trying to improve in this regard.

2. Also, because this is a business we built from scratch, I took the anger and confusion that y'all were feeling personally. As a result, the posts I made - especially during the earlier days of the move - reflected that anger I felt and that was unprofessional on my part to say the least.

I know many of you, your spouses, your kids, when you've had surgeries or if you have a big event coming up. I can wave on the street and call you by your first name.

I understand now that better, consistent communication with you could have thwarted a lot of the heightened emotions and am sorry that I allowed it to progress to those levels. This is a business and it should have been handled as such.

3. I tried to keep a lot of plates spinning prior to, and during the move. Too many plates. When they started crashing, I'll be honest - I got overwhelmed.

Fi****ms being returned to sellers without my knowing they were even shipped.
Buyers getting charged 15% restocking fees on guns I didn't know were being returned to sellers.
The ATF taking so long to move us.
Bills that still needed to be paid.
Parts and guns that needed to be ordered.
Chargebacks.
Refunds.
NFA stamps that missed being filed on time.
Angry, confused customers.
Getting jobs for the first time in 15 years.
Running the house
Groceries
Kids

..you get the idea. ZERO of this was intentional, but it all kind of snowballed into this horrible mess we have now and regardless of the situation, I'm dealing with it slowly but surely.

At the end of the day, the best I can do is to ask for your forgiveness for the current situation and know that I am diligently working to ensure every single customer is being taken care of.

Bankruptcy would have been the easy way out, but that isn't the right thing to do. You trusted us and you KNOW that we're better than that. As a result, I'm just asking for a few things:

1. Forgiveness. There are a lot of things I could have done to prevent the situation from escalating to the levels it has now. Looking back, I can see that now but didn't at the time due to my own bull-headedness and just being overwhelmed with it all. I am genuinely sorry for all of you who have hurt feelings, who have been inconvenienced, and who feel as though I betrayed your trust. I WILL DO BETTER EACH DAY.

2. Continued patience. Because of the challenge I'm tackling, it's difficult to know which email(s), private messages, etc to respond to if you're sending multiples. I have one customer who wrote me over 15 times between Friday and today, but I didn't see any of them until this morning. Many are asking for personal communication, which I am HAPPY to provide but it all takes time. Please direct all emails to john(at)fightingsheepdog(dot)com and I'll be happy to answer them as I'm able. That may mean the same day, maybe a few days will pass, but I will answer them all. Your patience is appreciated so very much.

3. A Chance to Make It Right. This is not going to be over and done tomorrow. I still plan to have fi****ms returned to customers within the month of July. But the refunds - those may take just a bit longer to complete, but they WILL be completed nonetheless.

I stand firm in my commitment to get every single customer taken care of. And while everyone wants to be the next customer that is taken care of, I can only go one person at a time. Just know that I have a list of ALL of you, and everyone will get the attention they require as I can give it to them.

Again, thank you to those who have reached out with words of encouragement or support. For those whom I've let down in any way during this process, I humbly apologize and ask your forgiveness. I look forward to taking care of every one of you as soon as humanly possible. - Rachel

Update 6/30/18: We've been continuing to work tirelessly to make appointments and get guns back to their owners. We're continuing to make appointments and keep those appointments for everyone who has a gun, accessories, NFA items, refunds, or anything combination thereof with us.

And we'll continue to do so until every single customer is taken care of. As I said, we are still working through the backlog of fi****ms and still hope to get everyone taken care of by the end of July. We'll continue to keep everyone updated here.

The ATF has concluded their work and we are 100% compliant with them, aka no criminal activity is going on per their findings. Local law enforcement has also been here and is satisfied that no criminal activity is going on here either.

Many of you who have been so patient with the process have asked when we'll be opening the doors for business and I've answered each question the same way - we won't even consider it until all existing customers have been taken care of. That's why there's no signage, still plastic on the inside of the windows, and the counter is bare wood. I'd rather get the customers taken care of before we put money into the showroom.

Once we get all existing customers taken care of, IF we decide to open, we'll look at current market trends and make our decision accordingly.

In the meantime, I appreciate the patience and understanding that so many of you have shown during this extremely difficult time.

Update 6/12/18: I've gone too long without an update. I apologize! The drive to return fi****ms, refunds, suppressors, and everything else to our customers hasn't changed. I'm still making appointments, keeping appointments, and working to ensure that everyone is taken care of.

Someone on this thread mentioned "ungrateful customers" and it surely was NOT us. We appreciate each and every one of you. Your patience through all of this, regardless of whether you've voiced irritation or not, has been appreciated.

The toll that this move has taken on our marriage, our family, our business, our health, and just our everyday lives has been tremendous and is in many cases irreversible. Everyone has been civil when coming to pick up their item(s) and I appreciate that more than you know. I'm happy to see some are posting here when they pick up their items.
