Dear Extar Customers,
Thank you to all who have purchased the Extar EP9. Today, the ATF published Rule 2021R-08F “Factoring Criteria for Fi****ms With an Attached Stabilizing Brace”. We are rightfully getting a lot of questions from our customers about how this rule will affect their EP9 pistols. Since this rule has just come out today, please give us some time to read it thoroughly and prepare an official statement on how this may affect EP9 owners. We can say with certainty that you do not have to register your EP9 pistol as an SBR, as you can remove and get rid of any brace that is attached and the rule will no longer affect the pistol. There is a chance that EP9s with the Extar Stabilizer will be legal as braced pistols, but we will have to submit a sample to the ATF for a determination. We cannot say for sure what the ATF will say, but since we designed the current EP9 and the Extar Stabilizer around passing the now defunct Worksheet 4999 (which the final rule maintains largely the same criteria), the outlook is positive for the EP9 being seen as a valid "braced pistol". The EP9 has always been sold and marketed as a pistol, and we have been careful to stay within the ATF’s guidelines in order to ensure the best outcome for our customers in the long term.
It is the belief of all here at Extar that this rule change is unlawful and will be deemed as such in the courts. We are looking into how Extar can help with the efforts in fighting this rule.
