RE: Common Law Trade Name Infringement-Cease & Desist

Mr. Thompson:

It has come to out attention that you are making unauthorized use of the trade name Gridiron Developmental Football League and/or GDFL (“GDFL”).

In addition, your use of GDFL causes confusion to consumers. Under Common Law and the State of Tennessee registration laws we are the owners of the trade name GDFL.

Therefore, we have the right, including but not limited to, restrict, prevent, or limit the use of GDFL in order to protect it against any misrepresentation.

We hereby demand that you cease and desist in any additional use of our trade name Gridiron Developmental Football League and/or GDFL as such use will likely cause misrepresentation in relation to the identification, advertising, and sales of our services.

If you fail to comply with the aforementioned demand within ten (10) days of the date of this letter we will have no choice but to pursue all legal causes of action available under State Law, Federal Law, and Common Law, including the filing of a lawsuit to protect our interests. Please be advised, this letter shall serve as pre-suit notice for a lawsuit against you and that failing to comply will likely result in you being liable for any damages a court determines, in its sole discretion, we have suffered because of your infringement.

It is in all parties’ best interests to amicably resolve this matter to avoid further legal remedies and expenses associated therewith.
