A 2014 court ruling made liability waivers unenforceable, driving up insurance costs, eliminating amenities, and forcing some recreation businesses to close. Oregon is now the only Western state without this protection.
A bipartisan bill - the Oregon Recreation Commerce and Affordability Act (ORCA) - would fix this and protect access to outdoor recreation statewide. It’s SB 1593 / HB 5071, and it needs community support to pass.
If you care about skiing, hiking, rafting, gyms, and affordable access to the outdoors, contact your legislators and ask them to support ORCA - or thank them if they already do.

• Since 2014, Oregon court rulings have invalidated liability waivers, driving insurance losses, skyrocketing premiums, and higher costs for consumers.
• Lack of waiver efficacy has resulted in fewer affordable, accessible recreation opportunities for Oregon families and visitors.
• ORCA is common-sense reform that supports well-managed recreation providers and promotes personal responsibility.
• ORCA aligns Oregon with the rest of the Western US.
• ORCA does NOT provide blanket immunity or remove constitutional rights.
• Recreation is vital to Oregon’s economy, culture, and quality of life.
• ORCA has bipartisan support with 18 legislative co-sponsors from across the state.
• Without action, Oregon faces higher costs, reduced offerings, and lost recreation access.
• Rural communities, jobs, and families dependent on tourism are at risk.
