🛡️ Self-Defense & The Law: What You Need to Know (CA vs. AZ)
​As a fi****ms instructor, I see a lot of confusion regarding "Stand Your Ground" laws. Whether you are a first-time owner or a CCW holder, knowing the legal boundaries is just as important as knowing your marksmanship fundamentals.
​1. California’s "Stand Your Ground"
​California doesn’t have a standalone "Stand Your Ground" statute, but the principle is protected under CALCRIM 505 & 506.
​No Duty to Retreat: In CA, you are not required to flee an attacker. You have the legal right to stand your ground and defend yourself.
​The GBI Threshold: This right is triggered only when you reasonably believe you are in imminent danger of death or Great Bodily Injury (GBI).
​What is GBI? It’s not just a scrap or a bruise. It’s "significant or substantial physical injury" (e.g., broken bones, deep lacerations, or concussions).
​2. The Arizona Controversy
​Recent headlines regarding the AZ Attorney General have people talking. While the debate over federal agents continues, it's important to remember: Arizona law explicitly exempts law enforcement from "Stand Your Ground" defenses. You cannot legally use force against an officer performing their duties.
​3. My Professional Take: Compliance is Key
​If you are detained for investigation: COMPLY. Under CA Penal Code § 834a, you have a legal duty to refrain from resisting. Not all cops are bad, but even if you believe an arrest is wrong, the street is not the place to argue it. Fight it in the courtroom, not on the sidewalk.
