Wow! This is crazy!
Open fields doctrine needs to be overturned. In Pennsylvania, two hunting clubs sued the Pennsylvania Game Commission after game wardens allegedly walked past “No Trespassing” signs and locked gates, entered private hunting club land without a warrant, and put trail cameras on the property. The state is relying on open fields doctrine, which basically says government officers can sneak onto your private land without a warrant because land outside your home does not get the same Fourth Amendment protection. That is wrong. In my opinion, it is unconstitutional, and it is exactly the kind of government overreach hunters should be fighting. If a hunter steps across the wrong fence line, he can get hammered. But under open fields doctrine, the government can walk past posted signs and surveil your land like the Constitution does not apply. Some states, like Tennessee, have already started pushing back against this kind of warrantless intrusion. Open fields doctrine must be overturned.
