Most families I talk with can tell me that their parent has a power of attorney, but far fewer can tell me what that document authorizes, and that's the piece that a bank or a care facility is going to care about.
I recommend asking these three questions to gain needed clarity:
▪️Can the named agent handle the financial transactions your family would realistically need handled?
▪️Does the document include the specific powers North Carolina law requires to be spelled out, such as making a gift or changing a beneficiary designation?
▪️Does anyone know where the signed original is kept?
If those documents were signed years ago, it's far easier to have them reviewed now than to sort things out in an emergency. At Davis Simmons PLLC, I help families take a clear look at what they already have before anything urgent happens.
