Isn’t it amazing that the National Oceanic and Atmospheric Administration (NOAA) has mismanaged this fishery for decades and then a rogue Federal judge blocks the first multi week Atlantic season in years Meanwhile the state of Louisiana took the “system” head on years ago and led the fight for reasonable seasons and limits. The result, a multi month 4 fish per person daily bag limit. Hopefully our local politicians will wake up and learn what good proactive governance can achieve. In the mean time the Gulf of America is enjoying another great snapper season. For more than 80 years, generations of military families, fishermen, outdoorsmen, and hardworking Americans have walked through our doors. We are thankful for every one of you and for the freedoms protected by those who served.

The federal government created the Magnuson–Stevens Fishery Conservation and Management Act to allegedly protect fisheries. However, many fishermen now believe the law has been twisted into a bureaucracy failure that ignores what people actually see on the water.

🎣 The Magnuson-Stevens Act may have started with good intentions, but today it gives unelected federal regulators too much power over America’s fishermen and coastal communities. Turning a rogue judge loose with this fisheries act is pouring fuel on the fire of NOAA bureaucracy and mismanagement.

Rigid federal quotas, flawed data models, and courtroom-driven management have devastated access while fish populations like Atlantic red snapper are visibly thriving offshore.

Families, charter captains, bait shops just like Browns Creek Fish Camp, Inc., and local economies are being punished by policies written in Washington and in this very case adjudicated in DC instead of by people who actually fish these waters.

It’s time to repeal or completely reform Magnuson-Stevens and return fisheries management to a system based on REAL science, state leadership, local knowledge, and reasonable public access.

The federal judge who issued the temporary injunction halting the expanded Atlantic red snapper season was Rudolph Contreras. He serves on the U.S. District Court for the District of Columbia in Washington, D.C. and has served since his appointment in 2012 by Barack Obama.

Judge Contreras granted the preliminary injunction on May 21, 2026, in a lawsuit brought by commercial fishing interests led by the Southeastern Fisheries Association challenging NOAA’s exempted fishing permits (EFPs) for Florida, Georgia, South Carolina, and North Carolina.

The ruling immediately halted the 39-day Florida Atlantic recreational red snapper season that was supposed to begin Memorial Day weekend.

Are you seeing red over the latest on the American Red Snapper saga?

On May 21, 2026, a rogue federal judge sided with activists in an attempt to block Floridians from exercising their right to fish through the recently approved Exempted Fishing Permit (EFP) for Atlantic Red Snapper issued by NOAA Fisheries earlier this month.

As a result of this ruling, NOAA has temporarily stalled Florida‘s Atlantic Red Snapper EFP. However, the agencies stand together in opposition of this delay tactic and will continue fighting for our fishing communities.

To that end, to ensure our anglers can get out on the water as planned beginning this weekend, FWC has modified its plans that will ensure access to fishing in our state waters. Effective May 21, FWC will rescind EO 26-11. Doing so will allow for the public to carry on with their plans on the water, including the ability to catch red snapper in state waters. As authorized by Florida Administrative Code, the recreational bag limit will default to 2 red snapper per person with a 20-inch size limit and remain in effect until further notice.

As for Florida’s historic EFP, when the EFP is unfrozen and ultimately restored, FWC will issue an updated EO reestablishing the extended red snapper season, which will increase the nautical miles available for fishing. Moreover, FWC officers have been notified of the unpredictable nature of the situation and will ensure boaters are provided education within our jurisdictional waters.
