Boycott Mount Bohemia Ski Resort Say no to the predatory litigation of Mt Bohemia on Keweenaw Businesses! https://www.gofundme.com/f/a-david-versus-goliath-story

Boycott Mt Bohemia Ski Resort until the Mount Bohemia Ski Resorts lawyers leave local businesses alone! Mount Bohemia is a geologic formation, (a mountain), that overlooks the lake and community of Lac La Belle, Michigan. The recent history of this mountain’s name can be traced back to the 1860s, when the Mount Bohemia mining company prospected for copper minerals on and in its slopes. For at least the past 40-years, many local businesses, including restaurants and gift shops, have used the name and likeness of Mount Bohemia, (not the ski resort), to sell novelty T-shirts, Sweatshirts, etc… to tourists and locals, alike. Now come the owner(s)/operator(s) of the Mount Bohemia Ski Resort, seeking to trademark the iconic, geologic formation, known as Mount Bohemia; and, in doing so, have sued Troy and Cathy Westcott, seeking to block them from selling any novelty T-shirts, Sweatshirts, or other gift shop items that mention the name or depict the likeness of this well-established, Keweenaw County, geologic formation. Troy and Cathy’s gift shop items and apparel have never used the likeness nor the logo of the Mount Bohemia Ski Resort. As previously-mentioned, the Lac La Belle Lodge, is a true “Mom and Pop” business that has been a part of the Lac La Belle Community, for over 80-years. And, while the geologic formation known for centuries as Mount Bohemia, has been a part of the Keweenaw Peninsula for millennia, the Mount Bohemia Ski Resort is a relative newcomer to the Lac La Belle Community. Unfortunately, for Troy and Cathy Westcott, the pockets of the owner(s)/operator(s) of the Mount Bohemia Ski Resort are very deep, indeed; and, as such, can lay siege, (legally-speaking), to the limited resources of a “Mom and Pop” business - seeking, through attrition, to grind Troy and Cathy into legal submission. Boycott Mount Bohemia Ski Resort is in no way affiliated with Troy and Cathy Westcott. This page stands with and supports the Westcott family, the owners of the Lac La Belle Lodge / Bear Belly Pit Stop.

From Troy and Cathy-

"We reached a settlement with Mount Bohemia Ski Resort during mediation January 24th. We are able to continue selling merchandise bearing the name Mount Bohemia as we had previously but the deal sunsets or ends in December of 2024.
This certainly was not the result we were hoping for, but mediation is a give and take where in the end neither side is necessarily thrilled with the agreement. However, with the toll the case was taking on our financial and physical wellbeing we felt it was the best decision for us to make at this time. If we didn’t settle, the trial date was not until January 2023. Our attorney estimated that it would possibly take another $75,000 to get to the finish line added to the $40,000 in attorney fees we have already encountered. Thankfully, the Go Fund Me supporters helped cover over $25,000 of those fees and we are truly blessed and thankful! However, envisioning another year of stress and encumbering another $75,000 in legal fees as well as countless hours spent on the case, we decided it was best to settle.
We have learned a lot the past several months, but the best thing we can take away from this experience is what an awesome community we live in and their unabashed love of their home. We want to sincerely and from the bottom of our hearts thank all the supporters in our community as well as around the country who have been involved through the Go Fund Me or through encouraging words by cards, emails or when seeing us in person. We were blown away by what a truly awesome and loving community that we live in and words alone can’t express our gratitude for the support we received the past few months. The support truly propped us up and gave us strength to get through this.
Even though this lawsuit was slapped upon us for selling merchandise with the words Mount Bohemia on them, to us this lawsuit was not about money or the sales of merchandise. This case for us was solely about preserving the name Mount Bohemia as a public landmark as it has always been. The sales of Mount Bohemia merchandise in our store represents less than ONE percent of our total sales revenue in a year, and two thirds of that one percent occurs in the summer season when the ski hill is closed! Certainly, not a very big part of our business and we doubt it negatively impacts his.
Bottom line, we firmly believe no one person or corporation has the right to trademark the geologic formation known for over a century as Mount Bohemia. We truly believe Mount Bohemia belongs to the people. We feel there is a strong case to support that and our hope that someone with the time and resources will agree and pick up the baton and take it to the finish line.
Thanks once again to all of you who supported us, it means more to us than you will ever know."
