In Poway Weapons v. Gonzales, our challenge to the California excise tax on guns and ammo, SAF has filed both a Motion for Summary Judgment, and its response to the State’s attempt to have the case dismissed. The filings argue the tax violates the Second Amendment under Bruen because acquiring arms is protected conduct and no historical tradition supports taxing a constitutional right. The matter is now teed up for the Sacramento Superior Court to decide as a pure legal question.
