Earth and Mars are gone from the Solar System. Sad to see this project created by two Westfield High students vandalized. Hopefully some organization will step up and put Mother Earth and Mars back on the Greenway.
This Thursday June 4th the Westfield City Council will be voting on an E-Bike Ordinance for the City. The Ordinance will set a speed limit on the Bike Trail as well as regulating the use of E-Bikes and other motorized devices on city streets and sidewalks.
Council meets at 6:00 PM at City Hall.
The Ordinance text is
AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CITY OF WESTFIELD,
MASSACHUSETTS, ADOPTED JUNE 17, 1993.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WESTFIELD AS
FOLLOWS:
That Chapter 17: Traffic and Motor Vehicles, of the Code of Ordinances be and is hereby
amended by ADDING:
Article XI: Electric Bicycles, Scooters, Mopeds and Skateboards:
Section 17-411: Definitions
(a) Class 1 Electric Bicycle-a bicycle or tricycle equipped with fully operational pedals and an
electric motor of 750 watts or less with a power output limit which provides power only when
the rider is pedaling but provides no power assistance above 20mph.
(b) Class 2 Electric Bicycle- a bicycle or tricycle equipped with fully operational pedals and an
electric motor of 750 watts or less with a power output limit which provides power with or
without pedaling but provides no power assistance above 20mph.
(c) Electric Scooter-any two-wheeled tandem or three-wheeled device that has handlebars,
designed to be stood or sat upon by the operator, powered by an electric or gas powered motor
that is capable of propelling the device with or without human propulsion.
(d) Electric/motorized Skateboard-a device with a platform (deck), two or more wheels and an
electric or gasoline motor designed for a person to stand or sit on while riding.
(e) Skateboard-a single platform mounted on wheels which is propelled solely by human power.
(f) Moped-have a cylinder capacity of no more than 50 cubic centimeters; have an automatic
transmission and be capable of a maximum speed of no more than 30 miles per hour.
Section 17-412: Use of Electric Bicycles, Scooters, Mopeds Skateboards on Streets:
(a) No use of electric or motorized scooters or mopeds without proper registration or compliance
decal pursuant to M.G.L.c.90, section 1D.
(b) No use of skateboards, motorized, electric or manual.
Section 17-413: Use of Electric Bicycles, Scooters, Mopeds and Skateboards on Sidewalks:
(a)No use of skateboards (motorized, electric or manual) on sidewalks within Court Street Mixed
Residence/Business District, Broad Street Mixed Residence/Business District or Commercial
Office Retail Enterprise District (CORE).
(b)No use of motorized or electric skateboards on any sidewalk in the City.
(c) No use of Electric Bicycles (Class 1 or 2) on any sidewalk in the City.
(d) No use of Electric Scooters on any sidewalk in the City.
(e) No use of Mopeds on any sidewalk in the City.
Section 17-414: Use of Electric Bicycles, Scooters, Mopeds and Skateboards on the Bike
Path/Rail Trail and Multi-use trails or Multi-use paths:
(a) No motorized or electric skateboards or electric scooters or mopeds.
(b) Throttled use of e-bikes is prohibited.
(c) All users are required to obey the 15mph speed limit.
(d) City vehicles are exempt from this section.
Section 17-415: Penalties
(a) The police department, through its authorized agents and employees, is hereby authorized to
enforce the provisions of this section pursuant to M.G.L. c.40, section 21D.
(b) Whoever violates the provisions of sections 17-412-17-414 shall be penalized by a non-
criminal penalty of $50 for the first offense, $100 for the second offense and $300 for the third
and each subsequent offense.
(c) Seizure of the bicycle pursuant to M.G.L.c.85, section 11B.
