Many of you know that there has been some exciting news coming out about tax stamps and the need to register SBRs, AOWs, Silencers and short barrel shotguns. It’s a step in the right direction for sure, however for us folks in Georgia there still comes a conflict with our current state laws. I’m sure in time it will all work itself out, but the current state laws are as follows:
O.C.G.A. § 16-11-122 - General prohibition
Georgia prohibits possession of a "silencer" (suppressor) unless an exception applies.
O.C.G.A. § 16-11-124 - NFA exemption
This section creates the key exception:
If your suppressor is properly registered under the federal National Fi****ms Act (NFA), the state prohibition does not apply.
Georgia fully defers to federal registration.
O.C.G.A. § 16-11-123 - Penalty Possessing an unregistered suppressor is a felony, punishable by five years imprisonment.
