On September 11, five holders of NYC non-resident carry licenses filed a federal class action against New York City.
The issue is one line in NYPD's licensing rules. A New York State resident with a city carry license can register two handguns as of right, and more with a showing of safe storage. Someone who lives outside New York State and holds the same license can register exactly one, and the rule says requests for more "shall not be approved."
The plaintiffs, from New Jersey, Pennsylvania, and Connecticut, argue the cap violates the Second Amendment and treats citizens of other states differently for no legitimate reason. According to the complaint, the city has never stated a public-safety purpose for it. Same license, same vetting, same one-gun-at-a-time carry rule, different number allowed on the card. The plaintiffs are represented by Mirel Fisch, a Brooklyn attorney who has filed several cases against the NYPD License Division.
Worth knowing for anyone in the tri-state area: NYC has issued carry licenses to non-residents since 2024. Same training requirement as residents, including the 18-hour course, plus a carry permit from where you live. The license is valid statewide.
