The 3rd party debate continues following the BCI North West Forum.

Conclusions ( in case you dont have access)

3rd Party Rights ( 1999 UK Third Parties Act) are dealt with by using the correct definition in your contracts.

3rd Party designations under regulations, provide for audit and assurance and should not confer 3rd Party Rights to suppliers.

Privity of contract ( 2 parties to a contract) will remain if contractual terms and conditions make this very clear.

In short and plain English 3rd Party Rights may lead to your organisation being sued under those rights.

TPRM is a separate regulatory requirement only.

Please be sure, you understand the difference and that your SLA and contract terms reflect the difference.

Its official, contracts are between 2 parties not 3.
